The Contested Divorce Process

Firstly, one party must ask for an injunction hearing where a judge will grant temporary orders for visitation, alimony, payment of debts, use of assets, and child support. Once the petition is filed, both parties will proceed to the pre-trial discovery phase. During this time, each side will send the other a list of questions known as interrogatories, which address financial specifics and may require producing documents such as bank statements, credit card bills, tax returns, etc.

As expected, this tends to bring out the worst in people as either party may not uphold their end of the bargain or attempt to throw the entire process off course. If no settlement is reached, the court will order you to mediation in a last attempt to have you and your ex minimize or resolve your differences. Eventually, the case will be tried in court before a judge or in a jury trial.
