In order to exercise your rights as a father, you will have to establish paternity, or legal fatherhood. In Texas, an unmarried woman who gives birth automatically gains full custody of the child. If a woman is married and gives birth, her husband is automatically granted joint custody. If the real father is not the husband, he must petition the court and submit to a DNA test to prove paternity.

There are two ways to establish paternity – you can do so by:

  • Voluntarily signing an Acknowledgement of Paternity form (the mother must sign, too).
  • Submitting a Petition to Adjudicate Parentage, which may require the alleged father to take a DNA test. Any party – the mother, the father, the child, or even the state if it is providing public assistance – may submit this petition.
