Visitation Rights & Access as a Grandparent

In Texas, grandparents do not inherently have legal visitation rights, though certain situations grant grandparents access to visit with and see their grandchild.

Conditions for grandparent visitation rights in a custody order depend on a determination that one of the child’s parents:

  • Is deceased
  • Is unable to provide the proper care
  • Is abusive
  • Is incarcerated
  • Has had their parental rights terminated

You may also have visitation rights if the child’s parents are divorced or if the child has lived with you for at least six months.
